GENERAL TERMS AND CONDITIONS OF SALE

Article 1 — Purpose and Scope
These General Terms and Conditions of Sale (GTC) detail the rights and obligations of Maison Cycle and its customers in connection with the sale of all products available on www.maisoncycle.com (the "Site").
They determine the terms and conditions under which Maison Cycle, an sole proprietorship, offers its products for sale to its customers on the Site, and apply exclusively to any order placed with Maison Cycle.
Any order placed on the Site implies full, entire and unreserved acceptance of these GTC. No special condition can prevail over these, unless formally agreed to in writing by Maison Cycle.
These GTC are subject to French law. Maison Cycle reserves the right to modify them at any time, without prior notice, it being understood that such modifications are not applicable to previously confirmed orders. It is advisable to reread them each time you visit the Site.
Article 2 — Nature of Products
The customer expressly acknowledges that the products sold by Maison Cycle are second-hand vintage goods.
The items available for sale are those listed on the Site at the time of consultation, within the limits of available stock. Maison Cycle reserves the right to withdraw from sale, at any time, any product present on the Site, and to replace or modify any associated information.
- Aesthetic condition: By nature, these objects bear the marks of time — patina, light scratches, paint chips — which constitute their authenticity and character, and cannot be considered defects.
- Photographs: The visuals published are as faithful as possible to reality, but are not contractual. Color variations may appear depending on the customer's screen settings. Despite the care taken in the descriptions, occasional errors may persist, which the customer acknowledges and accepts.
- Availability: As products are generally unique pieces, Maison Cycle cannot guarantee their availability in the event of simultaneous sale or unforeseen unavailability. The customer will be informed as soon as possible and fully refunded within 48 hours.
Items are only available for delivery in mainland France, including Corsica, and Monaco.
Article 3 — Customer
The customer declares to be at least 18 years old and to have the legal capacity, or to hold parental authorization allowing him to place an order on the Site.
The customer is solely responsible for the accuracy of the personal information he provides. He is responsible for the consequences resulting from false, inaccurate or illicit information communicated to Maison Cycle. The customer can modify his personal data from the "My account" section.
Article 4 — Order and Payment
Any order is only validated after payment acceptance. Maison Cycle then confirms the order by e-mail to the address provided by the customer, who formally accepts the use of e-mail for this purpose. In the absence of a confirmation e-mail, the customer is invited to contact Maison Cycle.
Payment is due immediately upon ordering. Accepted payment methods are credit card, PayPal and Apple Pay. Transactions are secured by SSL protocol via our payment partners. The customer expressly acknowledges that the communication of his bank details constitutes authorization to debit for the amount of the ordered products.
The data recorded by Maison Cycle and its payment providers constitute proof of the transactions that have taken place.
Maison Cycle reserves the right to suspend, cancel or refuse any order in the event of refusal of bank authorization, suspicion of fraud, or an unresolved dispute over a previous order.
Article 5 — Prices
Prices are indicated in euros (€), excluding shipping costs, which are specified before order validation.
VAT: Maison Cycle benefits from the VAT exemption scheme provided for in article 293 B of the General Tax Code. VAT is not applicable; therefore, no tax will be invoiced or recoverable by the buyer.
Maison Cycle reserves the right to modify its prices at any time. However, products are invoiced at the price in force at the time of order validation.
Article 6 — Delivery and Transfer of Risks
Deliveries are handled by Colissimo or by specialized carriers for bulky packages for complete bikes. Hand delivery may also be offered in some cases.
Delivery costs are added to the total invoice amount and are indicated before order validation. Delivery is free for purchases of €60 or more for any order in mainland France and Corsica.
Orders are prepared and shipped within 3 to 5 working days. During periods of high activity, this period may be extended to 10 days. The indicated deadlines are indicative; Maison Cycle cannot be held responsible for delivery delays attributable to the carrier.
Delivery cannot be made to hotels or post office boxes. The customer is responsible for the accuracy and completeness of the address information provided.
Each delivery is deemed to have been made as soon as the package is made available to the customer by the carrier.
Transfer of risks and verification upon delivery: The transfer of risks occurs upon delivery of the package. It is imperative that the customer inspects the bike in the presence of the delivery person. In case of a damaged package:
- The customer must refuse the package and immediately inform Maison Cycle.
- Failing this, he must make precise and detailed handwritten reservations on the delivery note (example: "bent frame", "twisted fork"), then confirm them to the carrier by registered letter with acknowledgment of receipt within three working days following delivery, with a copy to Maison Cycle. The generic mention "subject to unpacking" is devoid of any legal value.
Article 7 — Right of Withdrawal
In accordance with Article L. 221-18 of the Consumer Code and European Directive 2011/83/EU of October 25, 2011, the customer has a period of 14 calendar days from receipt of the bike to exercise their right of withdrawal, without having to justify their decision.
- Notification: The request must be sent by e-mail to contact@maisoncycle.com, in a clear and unequivocal manner. After this period, no withdrawal request will be processed.
- Return costs: Return costs are entirely at the customer's expense for refund requests. Given the volume and weight of the bikes, these costs are estimated between €60 and €150 depending on the carrier. They are covered by Maison Cycle if the delivered product is different from the ordered product or if it is delivered damaged.
- Condition of the returned product: The bike must be returned in its original packaging, complete, without any technical or aesthetic modification made by the customer. Any product returned incomplete, damaged or altered cannot be fully refunded.

Article 8 — Out of Stock and Order Refusal
Maison Cycle reserves the right to refuse or cancel an order after sending the confirmation e-mail, particularly in case of product unavailability, a dispute on a previous order, or suspicion of fraud. Maison Cycle cannot be held responsible for the harmful consequences of such refusal.
In case of unavailability of one or more products after the order has been placed, the customer will be notified by e-mail and reimbursed for the corresponding amount. If the entire order is unavailable, the customer will not be charged or will be fully refunded.
Article 9 — Legal Guarantees
Although the products are second-hand, Maison Cycle is bound by the following legal guarantees:
Legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code): Maison Cycle is liable for defects in conformity existing at the time of delivery. For a second-hand good, the presumption period for a defect is 12 months from delivery. In case of a defect, the customer chooses between repair and replacement, or failing that, a total or partial refund. These steps are carried out free of charge for the customer.
Guarantee against hidden defects (articles 1641 et seq. of the Civil Code): Maison Cycle guarantees against hidden defects that render the good unfit for the use for which it is intended or that diminish its use so much that the buyer would not have acquired it had he known of them (example: a structural crack invisible to the naked eye). The action must be brought within two years of the discovery of the defect. In the event of a hidden defect, the buyer can return the good and have the price refunded, or keep it and obtain a partial refund.
- Apparent defect: Any claim for an apparent defect must be reported by e-mail to contact@maisoncycle.com, prior to any return, so that Maison Cycle can validate its non-conformity.
For any request relating to guarantees, the customer should contact Maison Cycle first, in order to seek an amicable solution.
Article 10 — User Safety and Responsibility
Maison Cycle certifies that each bicycle sold has undergone a mechanical inspection prior to being offered for sale.
Nevertheless, the customer is informed of the following points:
- Vintage technologies: Vintage bikes are equipped with components from their era (less efficient rim braking, non-indexed derailleur, etc.). An adaptation of riding style is necessary.
- Appropriate use: The customer is solely responsible for ensuring that their practice is compatible with the equipment acquired. Maison Cycle declines all responsibility in the event of use not conforming to the product's intended purpose, particularly in competition, downhill or jumping.
- Regular maintenance: The customer undertakes to have their bicycle regularly checked by a professional, particularly the tightening, cables and brakes.
Article 11 — Force Majeure
Maison Cycle cannot be held responsible for any non-performance or delay in the performance of its obligations caused by an event beyond its control. Force majeure events include: strikes, riots, armed conflicts, natural disasters, fires, telecommunication network failures, epidemics, governmental acts or any other unforeseeable and irresistible circumstance. The performance of the GTC will be suspended for the duration of the force majeure event.
Article 12 — Consumer Mediation
In accordance with articles L. 611-1 et seq. of the Consumer Code, in the event of a dispute not amicably resolved within a reasonable period, the customer may freely resort to a consumer mediator within one year of their written complaint.

Article 13 — Intellectual Property
All elements of the Site maisoncycle.com — photographs, texts, logos, product sheets, layout, visuals — are the exclusive intellectual property of Maison Cycle and are protected by copyright. Any reproduction, representation or use, total or partial, without prior written authorization from Maison Cycle, is strictly prohibited and may lead to civil and criminal proceedings.
Article 14 — Personal Data Protection
The collection of personal data is essential for processing and shipping orders. The data collected are: last name, first name, delivery and billing address, e-mail address. By placing an order, the customer agrees that this data will be processed for the following purposes:
- Order and delivery management
- Billing and accounting management
- Complaint and dispute resolution
This data may be processed by Maison Cycle's service providers who host the Site and provide payment services. It is kept for a period of 5 years from the last use of the customer account, subject to applicable legal obligations.
Maison Cycle prohibits the sale, rental or transfer of collected personal data. In accordance with the Data Protection Act of January 6, 1978, and the General Data Protection Regulation (GDPR), the customer has a right to access, rectify, object to and delete their data, which can be exercised by e-mail to: contact@maisoncycle.com
Article 15 — General Provisions
- Severability: If any clause of these GTC is declared null or unenforceable, the other clauses retain their full force and effect.
- Non-waiver: No tolerance or inaction on the part of Maison Cycle can be interpreted as a waiver of its rights.
- Applicable law and jurisdiction: These GTC are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing agreement, French courts will have sole jurisdiction.
